1. Company Identification
The company BELOY is a simplified joint-stock company listed on the Paris Trade and Companies
Register under number 888 048 659, with its head office located at 19 rue du Rocher, 75008 Paris -
France. BELOY is registered in the French ORIAS Register under number 20006983 as an insurance
intermediary to operate in France and, under the freedom to provide services, in the European Union
("
BELOY" or the "
Company"). In the United Kingdom, BELOY is authorized and regulated
by the Financial Conduct Authority (FCA). BELOY is listed on the financial services register
(register.fca.org.uk) and its FCA
registration number is 978039..
BELOY is an insurtech company specializing in the protection of independent workers, green mobility
and bancassurance.
In this context, the Company operates a platform offering various on-line insurance, services and
benefits programs (the "Platform"), through which designated beneficiaries (the
"Users") can
subscribe to, or benefit from (through BELOY's partner clients (the "Clients")), said
programs
(together the "Services").
-
- any individual with a contractual relationship with a Client (employee, independent worker
using its services, customer, etc.) to whom the Client has proposed access to the Services;
-
- or any other individual authorized by BELOY.
These terms of use (the "Terms of Use") grant the Users a personal license allowing them to
access the Services.
To access the Services, the User must fill in the designated form on the Platform and, when
required, select the relevant Client by providing the individual identification number provided by
the Client.
The User must provide all information marked as mandatory.
Registration automatically results in the opening of an account in the User's name (the
"Account"), allowing the User to access the Services using their username (email address
provided during Account creation) and password.
Alternatively, when the User subscribes to a product sold online by BELOY (on its Platform or
through a dedicated customer journey proposed by BELOY or a Client) and has not previously created
an Account, the User provides the necessary information to create an Account during the purchase
process. The User’s Account will be automatically created by BELOY upon completion of the product
subscription so that the User can access the Services.
The Users can review the features of the Services directly on the Platform.
Once the User's Account is created, the User has access to an interface displaying the various
Services they can benefit from, whether preselected by a Client or made available by BELOY, and
organized into modules (the "Modules").
The Modules are sourced by BELOY with various partners, either for insurance Services (the
"Insurers") or for any other Service (the "Partners"). BELOY acts only as an
intermediary in the relationships established between Users and Insurers / Partners, as the Services
are provided directly by the Insurer or the Partner, as applicable, which the User acknowledges.
When the Services are subscribed by the Client for the benefit of eligible Users, the Services are
selected by the Client, who also sets their terms and content, at the sole discretion of the Client.
The Client can at any time request the removal or addition of Modules and Services and/or modify
their access conditions for the User.
The Modules include the following, with the specific terms for each Module being provided directly
to the User by the relevant Insurer or Partner and tailored to the particular Service.
This "Insurance Policies" Module includes 2 types of insurance products:
(i) collective insurance policies subscribed by a Client from an Insurer: eligible Users as
designated by the Client are then direct beneficiaries of the product;
(ii) individual insurance policies subscribed by a User for their own benefit from an Insurer;
(collectively, the "Insurance Policies").
The main Services associated with this Module are as follows:
(i) for individual insurance only: subscribing to an insurance policy with the selected Insurer, the
cost of which is directly paid by the User. In this case, the User enters into a contract with the
Insurer, which terms and conditions are provided to the User in accordance with legal requirements
(pre-contractual and contractual information);
(ii) access to the Insurance Policies’ dashboard (active and terminated) and the contractual and
pre-contractual documents applicable for such Insurance Policies;
(iii) submission and tracking of claims related to the Insurance Policies (the "Claims"); and
(iv) any other service such as a dedicated information page about the Insurance Policy, frequently
asked questions (FAQ), etc.
This "Deals & Discounts" Module allows eligible Users (either designated by a Client or who
subscribed directly to the Module) to benefit from online deals and discounts offers from Partners.
BELOY reserves the right to contract with the Partners of its choice for the sourcing and
management of the "Deals & Discounts" Module. In this case, the User must also contract directly
with the Partner to benefit from the Module.
BELOY reserves the possibility to source any other Service it deems useful, in the form and with
the functionalities and technical means that BELOY considers most appropriate to provide said
Services.
5. Coordination with Terms and Conditions of Payment Service Providers
All payments made through the Platform are managed by the payment service provider indicated on the
Platform (the "Payment Service Provider").
The User will contract directly with the Payment Service Provider in order to make these payments,
accepting its terms and conditions through a checkbox on the Platform.
6. Duration and Termination of Services
The User has access to the Platform from the creation of their Account until its deletion at their
initiative or BELOY's initiative following these Terms of Use (the "Account Duration").
The User may have access to one or more Services, which may vary during the Account Duration
depending on the Services subscribed by the Client for the User's benefit or by the User directly.
Therefore, the User has access to the various Services for the duration subscribed by the Client or
themselves.
When the Services are subscribed by the Client for the benefit of eligible Users, the User
acknowledges and accepts that if the Client terminates its contract with BELOY or the Insurer /
Partner, they will no longer have access to the Services associated with that contract. However,
they can continue to access their Account and other Services subscribed (by a Client or by
themselves) if applicable. If an Insurance Policy is terminated for any reason, the User can access
their Account to submit a Claim following the terms of the Insurance Policy.
When the Services are subscribed by the User individually, the User acknowledges that the duration
of said Service is the one they subscribed to directly with the Insurer or the Partner.
The User can request the deletion of their Account at any time by contacting BELOY at the following
email address:
support@beloy.com. BELOY
will
proceed to the deletion of the Account within five working days, provided that the Services have
ended and unless a law or regulation is preventing it (in which case BELOY will inform the User).
Upon deletion of their Account, the User will no longer be able to access the Services.
The User's Account may also be automatically deactivated by BELOY by application of the data
retention periods prescribed by regulations (including the General Data Protection Regulation or
GDPR) and BELOY’s Privacy Policy. The User will no longer be able to access the Services from the
date of deactivation.
Exceptionally, the User can continue to use the Services by subscribing to them directly on the
Platform (where possible) by contacting BELOY at the email address indicated in the "Company
Identification" section.
The Platform is accessible for free.
When the Services are subscribed by the Client for the benefit of eligible Users, such Users have
free access to the relevant Services.
When the Services are subscribed by the User individually, the price of any Module(s) selected by
the User, including individual Insurance Policies, is indicated on the Platform.
8.1 Intellectual Property Rights on the Platform
The Platform is the property of BELOY, including any software, infrastructures, databases, and
content of any kind (texts, images, visuals, music, logos, trademarks, etc.) that it operates. They
are protected by all applicable intellectual property rights or rights of database producers. The
license granted to the User does not involve any transfer of ownership.
The User is granted a non-exclusive, personal, and non-transferable SaaS license to use the Platform
for the Account Duration.
8.2 Intellectual Property Rights on Testimonials
For a duration of 10 years from the acceptance of the Terms of Use, the Users authorize BELOY to
use the testimonials they leave during the use of the Services (the "Testimonials") for the
promotion of the Platform under the following conditions:
- they consent to the display of their Testimonials by BELOY for free on the Platform and any other
French or foreign websites operated by any companies with which BELOY has agreements;
- they consent to the display of their Testimonials by BELOY by any means and on any medium to
promote the Platform;
- they accept that their Testimonials be translated into any language;
- they acknowledge and accept that the Testimonials may be subject to modifications, particularly in
terms of framing, format and colors, as well as altered or degraded in quality, based on the
technical constraints of the Platform;
- they waive the right to request any remuneration, fees or other financial compensation from BELOY
in this regard.
9. Use of Personality Attributes
For promotional operations that BELOY may launch to promote the Services, the User authorizes
BELOY to fix, reproduce, broadcast, and communicate to the public, in whole or in part, their
personal attributes, namely their image, first names / last names, and voice (the "Personality
Attributes").
This authorization is given for promotional and advertising purposes, on all media and by all known
or unknown methods to date, including:
- on all media, including printed, electronic, digital, computer, multimedia, of any kind, and by
all physical or immaterial methods, existing or future, foreseeable or unforeseeable;
- through all media, networks, and means of distribution, of any kind, existing or future,
foreseeable or unforeseeable, such as, without limitation, physical display, electronic
communication networks, especially the internet (fixed or mobile), broadcasting by all means (ground
radio waves, cable, satellite, DTT, free television, paid television, subscription-based,
pay-per-view, etc.) or display.
This authorization is granted worldwide and for a duration of 10 years from the acceptance of these
Terms of Use.
BELOY commits to refrain from exploiting the User's Personality Attributes in a manner that could
harm their reputation.
Moreover, the User understands and acknowledges that it may be difficult to remove their Personality
Attributes from BELOY's social media (such as LinkedIn, Facebook, Instagram, Pinterest, Tumblr, and
YouTube) and agrees that these elements may remain on social media as originally published, provided
that after the 10 years as mentioned above, BELOY does not republish or authorize others to
republish these elements.
10. User’s Obligations and Liability
10.1 Regarding the Account
- guarantees that the information provided in the form (when creating the Account or purchasing a
product) is accurate and agrees to keep it updated;
- acknowledges that this information constitutes proof of their identity and engages them upon
validation;
- is responsible for maintaining the confidentiality and security of their username and
password.
Any access to the Platform using these credentials is deemed to be made by the User. The User must
immediately contact BELOY at the contact details mentioned in the "Company Identification" section
if they find that their Account has been used without their knowledge.
The User acknowledges that BELOY has the right to take appropriate measures in such case.
10.2 Regarding the Use of Services
The User is responsible for their use of the Services and any information they share in this
context, especially with BELOY and with Insurers and Partners for the selected Modules. They commit
to use the Services personally and not to allow any third party to use them on their behalf.
The User commits not to misuse the Services for purposes other than those for which they were
designed, including:
- Engaging in illegal or fraudulent activities.
- Violating public order and morality.
- Infringing on third parties or their rights in any way.
- Violating a contractual, legislative, or regulatory provision.
- Engaging in any activity that may interfere with the IT systems of a third party, particularly to
violate its integrity or security.
- Carrying out maneuvers to promote their services and/or websites or those of a third party.
- Assisting or encouraging a third party to commit one or more of the acts or activities listed
above.
The User also commits not to:
- Copy, modify, or misappropriate any element owned by BELOY or any concept it operates within the
scope of the Services.
- Adopt any behavior that may interfere with or misappropriate BELOY's IT systems or compromise
BELOY's IT security measures.
- Infringe on BELOY's financial, commercial, or moral rights and interests.
- Market, transfer, or give access in any way to the Services, information hosted on the Platform,
or any element owned by BELOY.
- Use the Services outside the intended use in the contractual relationship between BELOY and the
Client or between the User and BELOY and/or an Insurer and/or a Partner.
BELOY acts as an insurance broker in the relationships between Users and Insurers and as an
intermediary in the relationships between Users and Partners. Therefore, BELOY cannot be held
liable in the context of these relationships with Insurers and Partners, nor be a party to any
possible disputes whatsoever.
11. BELOY's Obligations and Liability
Without prejudice to other obligations under the Terms of Use, BELOY commits to providing the
Services diligently and according to industry standards, with the understanding that it has an
obligation of means and not of result, which Users expressly acknowledge and accept.
BELOY commits to conduct regular checks to verify the operation and accessibility of the Platform.
In this regard, BELOY reserves the right to temporarily suspend access to the Platform for
maintenance reasons.
Similarly, BELOY cannot be held responsible for temporary difficulties or impossibilities of access
to the Platform that have their origin in circumstances that are external to it, force majeure, or
disruptions in telecommunications networks, Users being informed of the complexity of global
networks and the influx of internet users at certain times.
BELOY does not guarantee Users (i) that the Services, subject to constant research to improve their
performance and features, will be completely free from errors, defects, or flaws, (ii) that the
Services, being standard and not offered solely for a given client based on their own personal
constraints, will specifically meet their needs and expectations.
Damages resulting from BELOY's contractual breaches will be dealt with in the agreements between
BELOY and the Client, the Insurer, or the Partner, as the case may be.
However, the liability incurred by BELOY for personal damages suffered by the User is expressly
limited to the amount of the price received by BELOY for the Service that caused the damage.
As part of the Services, BELOY will process the personal data of Users as a data controller within
the meaning of applicable regulations on personal data protection. Our privacy policy is available

13. Hosting and Maintenance
BELOY commits to ensure, on the basis of an obligation of means, the hosting of any content
published by the User on the Platform in accordance with the practices of the profession and the
state of the art, on its own servers or via a professional hosting provider, conducting its activity
in accordance with the practices of the profession and the state of the art.
In this context, BELOY commits to providing Users with sufficient storage and processing capacities
for the purpose of the Services, following the practices of the profession and the state of the art.
BELOY commits to implement all technical means, in accordance with the state of the art, necessary
to ensure the security and access to the Services, covering the protection and monitoring of
infrastructures, control of physical and/or immaterial access to said infrastructures, as well as
the implementation of detection, prevention, and recovery measures to protect servers from malicious
acts.
BELOY also commits to take all useful precautions, given the nature of the data and the risks
presented by the automated data processing carried out for the needs of the Services, to preserve
the security of the data, particularly to prevent them from being distorted, damaged, or accessed by
unauthorized third parties.
Apart from any technical assistance, any anomaly detected by the Users related to the Platform may
be reported to BELOY by email at
support@beloy.com for analysis and processing.
BELOY offers technical support accessible via email at
support@beloy.com allowing Users to report any difficulties encountered when
using the Services.
15. Links and Third-Party Sites
BELOY cannot be held responsible for the technical availability of websites or mobile applications
operated by third parties (including Insurers and Partners) that the User would access through the
Platform.
BELOY assumes no responsibility for the content, advertisements, products, and/or services
available on such third-party websites and mobile applications, which are governed by their own
terms of use.
BELOY also cannot be held responsible for transactions between the User and any advertiser,
professional, or merchant (including Insurers and Partners) to which the User would be directed
through the Platform and cannot be a party to any possible disputes with these third parties
regarding, in particular, the delivery of products and/or services, warranties, statements, and any
other obligations to which these third parties are bound.
The User expressly acknowledges and accepts that:
- the data collected on the Platform and BELOY's IT systems is proof of the reality of the
operations carried out under these Terms of Use ;
- such data constitutes the main method of proof accepted between the parties.
17. Sanctions in Case of Breach
The obligations provided for in the article "User’s Obligations and Liability" are essential
obligations.
In the event of a breach by the User of their obligations, BELOY may suspend or delete the User's
access to the Services and/or the Platform and/or take legal action.
These sanctions are without prejudice to any damages that BELOY may claim from the User.
18. Modification of the Terms of Use
BELOY may modify its Terms of Use at any time and inform the User of such change in any writing
form (including by email). If the User continues to use the Services after the modified Terms of Use
come into effect, BELOY will consider that the User has accepted them.
If the User does not accept these modifications, the User must terminate the Services in accordance
with the provisions of the "Duration and Termination of Services" article.
The User has the right to have recourse, free of charge, to a consumer mediator for the amicable
resolution of any dispute relating to the execution of these Terms of Use that would oppose them to
BELOY as follows:
- for Users based in France, under the conditions provided for in articles L.611-1 and following and
R.152-1 and following of the French Consumer Code.
